NYAN ENUGU STATE COMMENDS HON. OKECHUKWU ANTHONY MBAH FOR SPONSORING LANDMARK BILL TO AMEND ENUGU STATE LANDLORD AND TENANT LAW
The leadership of the National Youth Assembly of Nigeria (NYAN), Enugu State Chapter, has commended Hon. Okechukwu Anthony Mbah, Member of the Enugu State House of Assembly representing Nkanu East Constituency, for his visionary sponsorship of a bill to amend the Landlord and Tenant Law of Enugu State. This commendable legislative initiative seeks to address pertinent issues affecting the housing sector in the state, ensuring more equitable and transparent relationships between landlords, tenants, and land agents.
_The proposed amendments in the bill seek to achieve the following:_
*Certification for Land Agents/Managers:* The bill mandates that any individual or entity wishing to operate as a land agent or property manager in Enugu State must obtain proper certification. This measure aims to professionalize the industry, ensuring that only qualified and credible agents manage properties, thereby safeguarding the interests of both landlords and tenants.
*Capping Agency and Legal Fees:* To curb exploitative practices, the bill proposes a 10% ceiling on both agency and legal fees associated with property rentals. While the percentage is negotiable below this limit, it cannot exceed the 10% threshold, ensuring affordability and transparency in rental transactions.
*Prohibition of Caution Fees:* The bill seeks to abolish the longstanding practice of demanding caution fees from tenants. This measure is designed to alleviate the financial burden on tenants while fostering a more tenant-friendly rental environment.
*Defined Duration for Notices:* The proposed law provides clear guidelines on the duration for different types of notices, including rent reviews, evictions, and lease terminations. This provision aims to eliminate ambiguities and conflicts arising from inadequate or inconsistent notice periods.

This recommendation is based on the reality that most tenants earn their income on a monthly basis, and such an arrangement would promote financial convenience and reduce the strain of bulk rent payments.
*Responsibility for Legal Fees:* NYAN suggests that the responsibility for legal fees should rest solely with the landlord, as the lawyer primarily represents the landlord's interests in rental agreements. Furthermore, tenancy agreements drafted by the landlord's lawyer are often skewed in the landlord's favour. Shifting the legal fee obligation to the landlord would enhance fairness and equity in landlord-tenant relationships.
